India’s competition watchdog is reportedly considering punishing WhatsApp for updating its privacy policy. WhatsApp is anticipated to receive an order from the Competition Commission of India (CCI) for breaking the nation’s antitrust laws, according to a Livemint report.
Why WhatsApp’s privacy policy update is criticized
WhatsApp announced a change to its privacy policy in 2021 that would permit it to share specific user data with its parent company, Meta (formerly Facebook).
WhatsApp’s controversial amendment to its terms of service and privacy policy, which had previously drawn a lot of criticism and alarm from both users and regulators, is the reason behind the CCI’s decision, according to the report.
What CCI alleges
As per media reports, anonymous sources say that the CCI has concluded that WhatsApp has an unfair competitive advantage because of its purported practice of sharing user business transaction data with Meta. According to a report issued by the CCI’s director general of inquiry (DG), WhatsApp and its parent company, Meta, have broken the rules of competition law that forbid abuse of dominance. Additionally, a draft order penalizing the corporations for the alleged infractions has been developed. According to the source, the draft will shortly be finished and sent to the two businesses.

The report quotes a WhatsApp spokesperson who said, “CCI proceedings are sub-judice, and we can’t comment on it. WhatsApp gave users the choice of accepting the Privacy Policy Update, and users who chose not to accept the update continue to use WhatsApp to communicate with friends and family without having their accounts deleted or losing functionality.”
