Apple and Amazon have successfully fought off a mass lawsuit in Britain over claimed cooperation between the tech giants to remove resellers of new Apple devices off Amazon’s website, a court determined on Tuesday.

Christine Riefa, a consumer law scholar, filed the action on behalf of almost 36 million British customers who had purchased Beats or Apple goods.

In order to lessen competition for items bearing the Apple and Beats brands, Riefa’s attorneys claimed that Apple and Amazon came to an agreement in 2018 to prohibit the great majority of resellers from Amazon’s marketplace in the UK.

Apple and Amazon requested that the Competition Appeal Tribunal deny the action, which is worth 494 million pounds ($602 million) plus interest, because it is without merit.

Regarding third-party funding for the action, the tribunal decided that Riefa had not shown “sufficient independence or robustness” to represent the claimant class, so the case could not proceed.

A request for comment was not immediately answered by Riefa’s attorneys or by representatives of Apple or Amazon.

Given the low standard for certification, the Competition Appeal Tribunal’s decision to decline to certify the case—an early stage in such litigation—is rare.
