The European Union’s framework for Al regulations is “bound to fail,” according to Sanjeev Sanyal, Secretary to the Government of India and a member of the Economic Advisory Council of the Prime Minister.

During an interview, Sanyal said, “The European AI framework has a very big lacunae because it requires bureaucrats of the European Union to be able to tell what’s ex-ante, what is risky, and what is not risky, which is not at all cumulative. Then, there is a Chinese approach, which is that the state knows it all. So, the state has all the information. It controls everything, and the state is therefore able to control.”

Sanyal has put up a paradigm based on Complex Adaptive System (CAS) theory that is centered around five major principles in relation to India’s Al laws.

These concepts include the need for manual overrides and authorized choke points, as well as the establishment of boundaries and protections to prevent destructive Al behavior. This guarantees that vital infrastructure is overseen by people so that important decisions can be made and assistance may be provided when needed.

In order to ensure transparency, accountability, and explainability, the principles also call for the open licensing of core algorithms and the ongoing monitoring of Al systems. Additionally, they mandate the implementation of incident reporting protocols to record system failures or aberrations, which will establish distinct lines of accountability for AI and guarantee “skin in the game” by holding developers or individuals accountable.

He has suggested the establishment of a specialized Al regulator in India with a wide-ranging mandate, as well as the creation of a national algorithm registry and a “national algorithm repository for Al innovation.” “Such a regulatory framework is necessary in response to the extreme measures being adopted by global economies.”

The development of India’s AI capabilities is an ongoing effort. It has authorized the India Al Mission, worth 210,372 crore. The purpose is to provide a uniform data platform, domain-specific large language models (LLMs), and graphic processing units (GPUs).

It will also offer a free non-personal data pool for creating business Al apps and training Al models. Concerning regulations, India has been releasing directives to make sure that Al instruments and goods don’t “undermine the integrity of the electoral process” before the country’s elections.

The European Artificial Intelligence Act (Al Act), which established a uniform framework based on a risk-based approach across all EU countries, went into effect on August 1, 2024. Using a risk-based strategy, the EU has divided Al systems into four categories: unacceptable, high, limited, and minimal risk, with rules for each.

Most Al systems, including spam filters and Al-powered video games, are free from duties under the Act; however, businesses are free to choose to implement additional norms of conduct. Chatbots and other similar systems need to notify users that they are communicating with a machine, and content created by Al needs to be properly tagged. High-risk AI systems, such as recruitment tools or medical software, have to meet certain requirements, like human oversight, clear user guidance, high-quality data sets, and risk reduction.

Systems that allow for “social scoring” by businesses or governments are forbidden since they seriously jeopardize fundamental rights.
